Standards Update to Chapter 296-155 WAC, Safety Standards for Construction Work

Crane Certifier Accreditation and Crane Certification effective January 2009

Crane Operator Qualifications and Certification will be effective in January 2010

The Department of Labor and Industries has updated the safety standards for construction work WAC 296-155, specifically the rules relating to cranes. The legislature passed Chapter 27, Laws of 2007 (Engrossed Substitute House Bill 2171) in response to a catastrophic tower crane accident that happened in Bellevue in November 2006. The first phase of this rule is for the construction crane certification program and operator qualifications, as outlined in RCW 49.17.400 through 440. The statute requires the department to establish by rule a crane certification program for cranes used in the construction industry, to establish requirements to become an accredited crane certifier, and to establish requirements that must be met to be considered a qualified crane operator.

The updates by WAC number and their effective dates:

WAC 296-155-531 through 296-155-53112 effective 1/1/2009

WAC 296-155-529 through 296-155-52902 will be effective 1/1/2010

WAC 296-155-53214 and WAC 296-155-53300 will be effective 1/1/2010

L&I Construction Crane Rules
The Department of Labor & Industries has concluded rulemaking regarding the proposed changes to the Construction Cranes rule Phase 1. Based on the oral and written comments received, the Department has adopted the regulations as indicated and detailed in the Concise Explanatory Statement. Detailed responses to all comments received during the comment process are also contained within the Concise Explanatory Statement.
